1. About Your House in the Sun

Your House in the Sun ("we", "us"), operates yourhouseinthesun.com, a Mediterranean property listing platform connecting buyers, sellers, real estate agencies and investors. By using the platform you are contracting with Your House in the Sun.

2. Acceptance and use of the platform

By creating an account or continuing to use the platform, you agree to these terms. You must provide accurate information, keep your account credentials confidential, and use the platform in accordance with applicable law in your jurisdiction and the country of the property.

3. Acceptable use

You must not misuse the platform. This includes, without limitation: unlawful use, fraud or spam, infringing anyone's intellectual property, posting misleading listings, or interfering with the security of the service (malware, probing, scraping or circumventing technical limits).

4. Listings & sellers

Sellers and agencies are solely responsible for the accuracy of their listings, including price, specifications, location and legal status of the property.

5. Payment, subscriptions and Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Paid packages for sellers, agencies and investors are billed per fixed listing period (90 days for Starter, Professional and Agency; 6 months for Diamond Executive) and renew automatically for the same period unless cancelled. Payment, billing, applicable taxes, cancellation and refund mechanics are governed by Paddle's Buyer Terms. Our own refund terms are set out in our Refund Policy.

6. Cancellation

Subscriptions may be cancelled at any time through your account settings or the billing portal. Access continues until the end of the current billing period.

7. Intellectual property

We retain ownership of the platform, its software, content, documentation and branding. You receive a limited, non-exclusive, non-transferable right to use the service within your selected plan. Reverse engineering, resale or redistribution of the platform is not permitted.

8. Service level and warranties

We do not guarantee that the platform will be uninterrupted or error-free. To the fullest extent permitted by law, all implied warranties, including merchantability and fitness for a particular purpose, are disclaimed.

9. Suspension and termination

We may suspend or terminate access in case of material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations.

10. Liability

Your House in the Sun facilitates connections between parties but is not itself a party to any real estate transaction. To the extent permitted by law, our aggregate liability is limited to the fees you paid in the twelve months preceding the claim, and we exclude indirect or consequential loss. Nothing excludes liability for fraud, death or personal injury caused by negligence.

11. Governing law

These terms are governed by the laws of the Netherlands. Disputes will be settled by the competent court in Rotterdam.
